The public planning record for this suburb runs to 98 entries, being every application on the NSW Planning Portal that carries both a demolition and the Lane Cove name, taken from Lane Cove Municipal Council’s own development and complying development registers. None of them are ours. Every address in them carries postcode 2066, which is about the only useful thing that postcode does.

Of those entries, 58 are development applications and 40 are complying development certificates, the route an accredited private certifier can issue against a fixed set of state standards.

The applications are where the rest of the ladder shows itself. Some were determined by council staff under delegated authority. More were determined by the council itself. A handful went to a local planning panel, and a few went further again to a regional planning panel. A small number name no decision-maker at all, which is a gap in the record rather than in the process.

Fourteen of those entries cover more than one address, and that is where the ladder starts climbing. One Austin Street application lists six separate lots on the one file. It went to a local planning panel, came back through a review of the determination, and a later application over the same six lots went to a panel again. Neither pathway is a choice you get to make

NSW gives a demolition two routes. A Complying Development Certificate is issued by an accredited private certifier against fixed state standards, with nothing weighed on merit: meet every standard and the certificate can issue. A Development Application goes to Lane Cove Municipal Council, which assesses the proposal on merit, notifies neighbours where the controls require it, and can approve with conditions or refuse.

Which one is open to you is read off your own land and your own scope. Zoning, heritage listing and conservation mapping open or close the certificate route. So does what you bundle in. The council decided ours "under delegated authority". Is that a lesser decision than the council deciding it?

No. It is the same consent, signed by a council officer holding authority to determine that class of application instead of the matter going up for a formal decision. It changes who signs, not what you are allowed to knock down or what conditions you have to meet.

Some entries on the public record do not say who determined them. Should that worry us?

Not for your job. Registers carry blanks, withdrawn lodgements and cancelled entries, and none of that is a comment on the land. We work from what your own consent or certificate says, never from what the entry next door happens to show.

The same two Bridge Street addresses appear on the register three separate times. What went wrong there?

Nothing that we can see. It reads as one piece of land tested three ways: a council decision, then a panel decision once a subdivision was written into the proposal, then a certificate once the scope suited the code. It is a fair warning about sequence, though. Change what you are asking for and you can change who decides it, so it is worth settling the end state before the demolition scope is drafted.
