Why the certificate route is harder to reach in this council area

New South Wales gives a demolition two ways through. A Complying Development Certificate is issued by a private certifier against a fixed state code: meet every standard in it and the certificate can issue, with nothing weighed on merit. Anything outside the code becomes a Development Application, which Hunters Hill Council assesses on merit, notifies where its controls require, and may approve with conditions or refuse.

Eligibility follows the land and the scope of the job, not how straightforward it looks from the footpath. Zoning, heritage listing and conservation area mapping are what open or close the certificate route, and this is the council area where that mapping bites hardest. Scope matters too: a bare knockdown often qualifies, while one bundled with a subdivision or a dual occupancy usually does not. Here, merit assessment is the ordinary outcome rather than the exception.

A certifier has looked at our block and will not issue a certificate. Is that a refusal?

No. It means the land or the proposal misses a standard in the code, which is a pass or fail test rather than a judgement about your plans. The job then goes to the council on merit, which is the route most demolition here takes anyway.

Does the council area change anything on site, or only the paperwork?

Both, though what happens on site depends more on what is around you. Work is carried out to Australian Standard 2601-2001, with a Work Method Statement written for your address setting out the order the structure comes down in and how neighbouring walls and fences are protected.
